When his demands were not met, he used both hands to smash the window. Once police arrived, they tried to arrest Ah-See, but he threatened them first with a paver and then with a chair, finally throwing the chair at an officer. The facts said officers tried to use capsicum spray with little effect and Ah-See threw a second chair and a pot plant on the front lawn. Police then wrestled AhSee to the ground while he struggled and it took several baton blows before police could handcuff him. He was on bail from Dubbo District Court at the time and had failed to report to police since December 31. According to the pre-sentence report, Ah-See had been under the influence of Oxycontin during the incident and had been removed from the methadone program because he missed three doses. The report also said AhSee had been in aggressive during his time in custody. In court, his solicitor Paul Johnson said his client pleaded guilty and asked for a sentence of time served. “He just didn't want to put the community to any extra cost and expense of having a hearing,” he said. “While assaulting police and resisting arrest are not trivial, these aren't the most serious matters.” Magistrate Terry Lucas noted he had a suspended sentence and a good behaviour bond for similar offences. Mr Lucas sentenced him to 10 months’ jail with a non-parole period of six months, backdated to the incident. Ah-See will be eligible for release on July 8, although he will remain in custody until his district court trial.
